Administrator Deed

  • Must have name of the Administrator and whom they are the Administrator for.
  • Legal description.

  • *Can also be titled "Fiduciary Deed".

Addendum

  • Must refer to mortgage Volume and Page.

Affidavit of Forfeiture

  • Must have Volume and Page of lease.
  • Must have proof of service or proof of publication in newspaper.

Affidavit Against Forfeiture (ORC 5301.332)

  • Must be an original.
  • Must have Volume and Page of lease.
  • Must state or claim that the lease has not been forfeited.
  • Must state or claim that the lease is in full force and effect.

Affidavit of Noncompliance

Affidavit

  • Notice to Commence Suit for a mechanics lien attached to affidavit requirements: Legal description, record owner(s), Volume/Page of lien, proof of service by the Sheriff, notary and prepared by.
  • Affidavits that affect ownership may require two stamps from the Auditor. Legal description, record owner(s) name, notary and prepared by. Please check with the Auditor.
  • Affidavits that do NOT affect ownership requires: Legal description, notary, prepared by and record owner(s) name.
  • Affidavits used as a release (Affidavit of Completion for a Notice of Commencement) does NOT require a legal description but needs the Volume and Page of what is being released, owner(s) name, notary and prepared by.

Affidavit of Successor Trustee

  • Legal description.
  • Must be reviewed by the Auditor. Review stamp only. No transfer stamp needed.
  • Must state why trustee is being placed.  Example: resignation, death, or incompetence. If because of death, the death certificate must be attached.  The death certificate does not need to be certified, just a copy.
  • Notary and Prepared By.
  • Fee ~ $28.00 for the 1st two pages + $8.00 each additional page.

Affidavit of Survivorship

  • Must be reviewed by the Auditor. Both review and transfer stamp needed.
  • Certified copy of the death certificate.

Bankruptcy

  • Can be a certified copy.

Bureau of Workers Compensation Liens (CPD)

  • Fee ~ no charge.

Bureau of Workers' Compensation Lien Release (CPD)

  • Do not send back.  Kept to attach to original lien.
  • Fee ~ No charge.

Change of Name

  • Must be a Certified Copy from the Secretary of State (similar to a Merger).
  • Fee ~ $28.00 for the 1st two pages + $8.00 each additional page.
  • *If a Change of Name is attached to an Affidavit we file it as an Affidavit using the same requirements as a normal Affidavit.

Corner Line Agreement

  • Legal description.
  • Must have the names of the adjacent owners involved.
  • Notary and Prepared By.
  • Fee ~ $28.00 for the 1st two pages + $8.00 each additional page.

Consolidation

  • Notary and Prepared By.
  • Fee ~ $32.00 for the first 2 pages (includes one marginal notation) + $4.00 for each additional marginal notation + $8.00 each additional page.
  • *This document refers to a group of separate leases that are being consolidated into one lease. The document usually has the lessors names but can be accepted with just the unit number (example: Miller Unit #3).

Court Release (For Mortgages or Mechanic's Liens)

  • Must have Volume and Page of lien being released.
  • Must be signed by Clerk of Courts
  • Does NOT need a prepared by or a notary.
  • Fee ~ $32.00 for the first 2 pages (includes one marginal notation) + $4.00 for each additional marginal notation + $8.00 each additional page.

Certificate of Transfer

  • Legal description.
  • Must be reviewed by the Auditor. Both review and transfer stamp needed.

  • *Comes from Probate Court with a deputy signature, seal and certified stamp OR signed by a deputy in the space under the copy of the judge's signature.

Commissioners Deed

  • Legal description.
  • Notary and Prepared By.
  • Must be reviewed by the Auditor. Both review and transfer stamp needed.
  • Fee ~ $28.00 for the 1st two pages + $8.00 each additional page.

Deed

  • Legal description.
  • Notary and Prepared By.
  • Must be reviewed by the Auditor. Both review and transfer stamp needed.
  • Fee ~ $28.00 for the 1st two pages + $8.00 each additional page.
  • *This covers Warranty Deed, Quit Claim Deed, and Survivorship Deed
  • **Affidavit of TOD (Transfer on Death) designation (does not go to the Auditor)

Declaration

  • Usually filed with condo plats.
  • Filed before condo plats unless asked differently.
  • Auditor signs the cover page when filed with a plat.
  • Fee ~ $28.00 for the 1st two pages + $8.00 each additional page.

Disclaimer

  • Must go to the Auditor first.
  • Must have a review stamp and transfer stamp from the Auditor's Office.

Executor Deed

  • Legal description.
  • Notary and Prepared By.
  • Must be reviewed by the Auditor. Both review and transfer stamp needed.
  • Must have the name of the deceased person and Executor.
  • Can be called Executor Deed or Fiduciary Deed.
  • Fee ~ $28.00 for the 1st two pages + $8.00 each additional page.

Easement

  • Legal description.
  • Notary and Prepared By.
  • Must be reviewed by Auditor. Only transfer stamp needed.
  • Fee ~ $28.00 for the 1st two pages + $8.00 each additional page.

Easement Amendment

  • Must have Volume and Page of the original easement.
  • Notary and Prepared By.
  • May have Auditor's stamp but it is not necessary.
  • Fee ~ $32.00 for the first 2 pages (includes one marginal notation) + $4.00 for each additional marginal notation + $8.00 each additional page.

Encumbrance

  • Must have Volume and Page of mortgage.
  • Notary and Prepared By.
  • Fee ~ $32.00 for the first 2 pages (includes one marginal notation) + $4.00 for each additional marginal notation + $8.00 each additional page.

Extension

  • Must have Volume and Page.
  • Notary and Prepared By.
  • Usually extending the term of a lease.

Fiduciary Deed

  • See ~ Administrator Deed, Executor Deed, Guardian Deed and/or Trustee Deed.

Guardian Deed (Fiduciary Deed)

  • Must go to the Auditor to review and transfer.
  • Notary and Prepared By.
  • Fee ~ $28.00 for the 1st two pages + $8.00 each additional page.

IRS Liens

  • Fee ~ $5.00

IRS Lien Release

  • Make sure the release has the file number of the lien it is releasing.
  • One release per form.
  • Fee ~ $3.00

Judgment

  • Must be a certified copy from the court system.
  • Requires a legal description if the judgment is being filed to transfer property, is acting as an easement or affects the property.
  • The judgment must order the Recorder's office to accept the document unless the judgment is being used to release a lien.
  • If the judgment is being used to release a lien it must have the volume and page of the lien it is releasing.
  • Does NOT require a prepared by or a notary.
  • Fee ~ $28.00 for the 1st two pages + $8.00 each additional page.

Land Contract

  • Must be approved by the map room unless the property is a sublot.
  • Must have signatures of both vendor and vendee.
  • Legal description.

Lease

  • Notary and Prepared By.

Lease Assignment

Lease Amendment

  • Must have Volume and Page of original lease.
  • Does NOT require a legal description.

Lease Release

  • Must have Volume and Page of original lease.
  • Does NOT require a legal description.

Lien

  • Notary and Prepared By.
  • Covers any type of lien other than a Mechanic Lien. Example: Homeowners Association Lien.
  • Homeowners Association Liens do NOT require a legal description.
  • Liens against a public entity (such as the Commissioners) are usually titled lien rather than Mechanic Liens.
  • For liens placed for work done on a portion of the road no legal description is required other than the Township and where the work is being done.
  • Fee ~ $28.00 for the 1st two pages + $8.00 each additional page.

Lien Release

  • Used for any release besides a Mechanic's Lien Release.
  • Must have the Volume and Page of the original lien.
  • Does NOT require a legal description.
  • Notary and Prepared By.
  • Fee ~ $32.00 for the first 2 pages (includes one marginal notation) + $4.00 for each additional marginal notation + $8.00 each additional page.

Living Will

  • Must be either notarized or witnessed (both is not necessary).
  • Fee ~ $28.00 for one or two pages, $36.00 for three pages and $40.00 for four or more pages

Health Care Power of Attorney

  • A Health Care Power of Attorney may be attached as part of the Living Will to cut costs and is just recorded as a Living Will.
  • Must have 2 witnesses OR a notary (both is not necessary).
  • Fee ~ $28.00 for the 1st two pages + $8.00 each additional page.

Loan Limit

  • Must have Volume and Page of mortgage.
  • Notary and Prepared By.

Mechanic's Lien

  • Must have ONE contractors name.

Notice of Personal Property Transfer (NPPT) ORC §317.03(E)(1)

  • Must meet standardizations guidelines
  • Must contain a Transferor, Transferee and item being transferred
  • Notary and Prepared by
  • NPPTs transferring property must first be recorded as a Deed
  • If you record an NPPT first as a Deed, you must have a second original to record as an NPPT
  • You must designate how you want the documents recorded

Vacated Sublot

  • Form filled out by the Auditor's Office.

  • Auditor's signature is usually signed by a deputy Auditor and initialed.
  • Must have the sublot number(s) that are being vacated, subdivision name and Volume and Page of the plat.
  • Fee ~ $2.00 per sublot.

Waiver of Priority

  • Requires two Volume and Page numbers.  One for the older mortgage and one for the new mortgage
